Visitors car towed on first occurrence with no pass by HOA. Any room to fight it?

Father in laws car towed from the street. They stayed with us Friday night, woke up Saturday morning and it was gone. Figured it was stolen because we didn't think they would tow it for any reason. Yes, we did not give them the pass, they got in late and it didn't even cross our mind. For sure our fault there but after reading a recent update to the parking rules the board decided to change the rule that any car without a pass will be towed on the first occurrence. This seems pretty ridiculous to all of us. Have to wait tell Tuesday to talk to our HOA guy. Going to try and fight it just wanted to see if anyone had any advice on an angle to take. I also take full blame for not giving them the pass so will understand if most people on here will respond with the obvious to bad, deal with it, but for those of you that have some help I really appreciate it.
