HOA lawsuit question?

This may seem like a bitter or stupid question to most but basically I wrote an email to my HOA and complained how security recently is out if control. They're abusing their power and being rude to the residents. Upon receiving a reply from a high ranking member VIA email about the issue saying we will take this serious and look into it asap. Upon fully examining the email I noticed it was firwarded frim another HOA employee and she forwarded the message to him "this one like fun" basically meaning this guy sounds like a whiny bitchy resident have fun with his complaint eric. That's what I got out of it anyways. Can I sue the HOA or her directly for that comment which pissed me off? Isn't it slander or deformation or w/e its called. If not does it break any laws at it all or is it rude and get over it and leave it at that?

I bought a real estate and there was a lien on it. we close escrow and now i find out that the lien has not been paid in full. I want to know who is responsible for this mess. I thought title company get paid to make sure you are buying a title free lien? Can somebody explain me whom do I have to go after? The HOA demand was $3001 late fee. so we paid them but now the HOA is coming back and asking for attorneys' fee so they could remove the lien. I title or escrow or the HOA is the one in fault. Why are HOAs so BAD,GREEDY, and have dumb rules?

HOA in Orlando Florida is a monstrosity. Two payments per month, late and reminder fees, don't answer questions, $500 for leasing out my unit. I had enough and stopped all payments to them and stopped paying the mortgage after I stripped out the condo of all appliances, lights, and even took out the carpet. Stop mortgage payments due to bad HOA?

A have a condo in Orlando, Fla. Lost value from $262k to $120k. But the HOA is the real problem. These scumbags charge $500 for bringing in a renter. I had an issue with them and they never responded, just added another fee instead. That is when I stopped all HOA payments and mortgage payments. I could work something out with the bank on the mortgage, but it is the HOA that is the problem. I am done with the greedy HOA therefore have not paid anything more in a year.

The other day, my downstairs neighbor notified me that water was leaking into their unit. Not knowing where the water was coming from, he called the building manager (we live in a condo building) to come out and look for the leak. I am just so irritated that I am being charged for the property manager to come out to "look" when he did not do anything specifically to my unit. Who should pay for this bill? I feel like it should have been charged to the HOA if he did not enter my unit.

Ok I left my cell phone ( SCH-R451c Samsung Trac-fone ) in the rain and it's now all dry but only one key does not work! And ITS THE POWER BUTTON!! It will charge and turn on when chargeing but not so i can mess with it! I live in Louisiana. This particular condominium complex utilizes assigned parking spots, one for each condominium. There are also visitor marked parking spots available for guests, however, nearly 75% of them are being used by residents as most condominiums house 2 people. Recently one of my more trashy neighbors who lives alone with one car decided that she was going to raise a stink about all the residents using the visitor parking for their second vehicles. She claims that she can have our vehicles towed. Is this common practice? As I said, there a vast number of residents who also utilize the visitor parking, so even if there was some minuscule regulation siding with her there would be at least a dozen or more vehicles that are in violation. No one else has ever complained, and several of those I have spoken to agree that she is acting like a nut job. The joke is that her main issue seems to be one visitor spot in particular that she is under the impression belongs to her mother in some way when she decides to visit, which is nearly on a daily basis. Because of increased 2 vehicle household, sometimes mommy has to walk more that ten feet to her car and I guess we can't have that can we? As is fairly typical, the complex manager does not want to get involved and is not being particularly helpful. What are your opinions on the matter? If they decide to implement such a rule, the owners of each unit would be very hard pressed to find renters, so I highly doubt that the HOA will see the side of one little spoiled brat who didn't get her every way. I personally have had to deal with much worse issues regarding apartment/condo life and can only assume she has not. This is all a huge nuisance to me. I wish people would just stop trying to create drama out of nothing simply for the sake of exerting control over others.

I say You can never be too careful with people out there. You're both adults however, and its completely up to you, if you guys want to meet, you'd probably be better off with you brought a friend with you or someone in your family, just to be safe. Make sure that when you're with him that you stand up for yourself, meaning don't let him make you do anything you don't feel comfortable doing. I have been wondering if it would be legal to set up a camera/warning system that says that if somone steps more than five feet onto my lawn that I will sue them for tresspassing. We live in a neighborhood that has deed restrictions and an HOA. I don't mind it, but recently is started working nights and my wife works days. We have'n't had a chance to mow our lawn in a couple weeks, it is a bit grown up but it's not really that bad. Although aparently there has been a complaint or 2. The thing is today someone stopped by to tell me about it, and said he decided to tell me instead of having me written up as we are new in the neighborhood. When you buy a foreclosure and have to pay all previous HOA dues of previous owner due you Think it's fair?

Im not an attorney Mortgage companies, when properties are sold at Foreclosures, pay 6-12 of past dues but consumers are legislated by law to pay all back dues in Florida. Is this a form of discrimination or not? I can't find any case law where it's been challenged. It would make a good case for any attorney that's up to the challenge.

How to remove an HOA?

The community we live in has a horrible HOA. It is a company that is put in charge of the community. I have yet to find a person who likes the employes of the HOA. I don't think it would be hard to gain the support of the community. What can we do to get them out of power get a new company, what are the steps? Any advice would be great.

I'm 13, and everything in my life is so effed up?

I'm 13 years old, which is the first thing I should mention. There are so many problems in my life right now, and it's really getting to me. First, my dad. He's 58 years old, a smoker since the age of 15 but trying to quit, and a good candidate for Alzheimer's disease. He has a lot of trouble remembering things, and it runs in my family. He is also a very good candidate for lung cancer. His father died from a stroke or a heart attack before I was born (I forget...), and his mother just died from lung cancer. She only smoked for 20 years and quit about 40 years ago. He is also an alcoholic (not a severe one though). He got really, really drunk a couple nights ago and stumbled and hit his head on the balcony. He had to get stitches on his forehead and his eyes are bruised, and his nose is cut up. Next, my mom (50 years old). She is severely depressed. Her mom committed suicide before I was born, and her dad is suffering from congestive heart failure. She does A LOT of weed every night. She is also very, very dramatic (being depressed and all) and cries about twice a week. She and my dad don't get along at all and my dad gets frustrated really easily. Her mom killed herself when she (my grandma) and her husband (my grandpa, the only grandparent still alive) got a divorce. If my mom and dad ever get divorced, which they probably will since they don't get along at all, I really think she will do the same. All my mom ever does is loads up on anti-depressants then goes to sleep. Oh, and smokes weed. Then, she loads all her problems with her father and my dad onto us and cries to us. She is overweight too, and she never ever eats. It's scary. But she never loses weight. Then, there's my sister. My mom doesn't get along with her either. They have had two fights today alone. My sister is 17 years old and goes out and parties a lot. She is a really good kid though, like she has never ever done weed (thank god, since it runs in my family haha), has a 4.7 GPA, and is still a virgin (awkward?). She just likes to have fun with her friends on summer nights. She does drink, but not excessively. But the thing with her is that I think she has some form of mental disease. I think she might be anorexic. You may want to walk away and you with legal matters such as these, it could take considerable time to work them out. As for the seller, they should have know and disclosed I would think before accepting your offer. Lender has every right to deny a loan on property for that reason. But to protect yourself, I would hire an attorney.

Landscaping Nightmare--Please help. Do I yank everything?

how did it become the 'tenant's responsibility' to 'keep up the landscaping'?????... you might have to trim and mow, but that's as far as that should go.... the landscaping belongs to the landlord and you didn't install the mess, so it's not YOURS to be bothered with..... especially when you don't have the knowledge base that is required to do it right..... let the landlord know that you'll mow and trim but that he needs to send a gardener over to get the place in shape..... if it's that bad, the folks before you didn't have the time or the know-how EITHER... and you shouldn't have to fix THEIR mess..... if he balks, work out an arrangement for the summer where you pay the landscaper a reasonable fee, thru the RENT you give the landlord.... you don't pay the landscaper directly, as he's not working for YOU, but for the landlord!!!..... don't let them put this off on you!!!.....

Neighbor is harassing is, dont know what to do anymore?

How can I find a home that is not under the rules and regulations of the HOA?

I need to know how I can go about finding a home that is not in an HOA neighborhood; doesn't really need to be in a subdivision at all. I want to do a Google search, and maybe I am doing something wrong, but I can't find any information on that. I'm beginning to think it's the type of thing where numerous real estate agents are only listing HOA homes on their websites for a reason. However, I am dealing with a great real estate agent; the likes of who anyone would be happy to deal with. All I know is that I do NOT want under the Home Owners Association--period. Just because a couple divorces does not mean one name automatically comes off the mortgage loan, a release of lien has to be granted by her to your husband and than he needs to have it registered with the county clerk and then submit this to the bank. Much of this should have been done by his attorney. As for the hoa, why are they suing him for her name not being off the their records? If you are living in the home then you should be paying the fees. Im not sure you were clear on this point.

How to install a bathroom fan in a condo that doesn't have one already?

we own our condo and want to install a bathroom fan in our master bathroom which currently does not have one at all. I can find a lot of information about replacing bathroom fans and only a little for actually installing a new one.. however those only explain how to install it if you live in a house and have access to the ceiling... so is this something i need to ask my HOA to do? or is there another way to do this?? Are my neighbors racially harassing me?

We are a black family living in a predominantely white neighborhood. We just moved in 2 months ago. We chose the neighborhood because it looked "family friendly" and was in a great school district. However, there are a set of neighbors that have cursed our children out and demanded that our children stay out of their yard, yet their kids wander in our yard every day while they drink beers in their garage. The couple decided to write a letter to our HOA and report that our kids play in the street, we live in a cul-de-sac, that I have an unlicensed daycare, I am licenced, and that our kids leave trash in our yard and other people's yard. They are the only neighbors that have complained. My kids never eat outside or leave trash. My other neighbor leaves his trash out for weeks and it blows all over. Our HOA found the charges unfounded and told the couple to lay off. They have now since called the DSS and reported that our 4 year old was outside at 11pm. My kids go to bed by 9. They reported about the illegal daycare. I have my license. They stated that the kids play in the street and are not watched over. I have pictures of their kids in the street and me telling them to move to the side while their parents are no where to be found. The wife has also made comments to my husband that the neighborhood feels "overwhelmed" because we have a large family. We have 9 kids. We also pay all of our own bills and take very good care of them. Before we bought the house, the couple came over asking the owners if they were going to sell the house to us. Once they found out that she was, they stopped their children from coming over and stopped talking to her. I wonder, what can we do to stop this harrassment? I don't trust them and don't want the to hurt my kids!

The community I live in is a gated single family home neighborhood. The home next door to mine is in foreclosure and rented out. The family has 8 dogs, which live full time in crates in the garage. They bark often and the smell coming out of the garage is horrible. We are the second neighbor to complain and they have been sent a letter from the HOA stating there is a 2 pet limit here and you cannot breed animals here, they also breed them. They still have the dogs, can the HOA pursue them legally and kick them out?

We have a 30 yr fixed FHA mortgage and we have been in the home for 3 years. It's a condo with HOA. Factoring the HOA, our costs per month are $1650. The wife and I are curious if we can possibly rent out our condo (primary/only home) and then find a place to rent in a different location for only $1000/month for a couple of years. We could then be able to save money. Is there tax implications for renting our primary residence? Is this something that is simple enough for basic people to do or is there a lot of work/paperwork involved? I know we would need to get new/different insurance on the condo. How do i get the neighbor's dog to stop barking?

we live in an HOA neighborhood, and in the HOA rules it only allows people to have two animals (regular animals, like dogs, cats, fish, no barn yard animals, pigs, chickens, ducks) but my neighbor who lives across the creek, have a schnauzer dog, and it is so annoying! it barks nearly non-stop all afternoon (the dog is out when i get home from school) and it is out there for a good 2-4 hours and is let back in then put back out at 5 Pm and is usually left out there until 6:30pm or 7:30 pm , and they let the thing in and then put it out inbetween 5:00-5:30 Am every morning. it would be fine if they left the stupid thing out but the dog barks constantly. its really annoying. that and the stupid geese (we live behind a VFW pond and there are a ton of geese that live back there and like to honk at 4:30 in the morning) and i can't sleep any more usually on school days i could sleep until 6:25-6:30 am. but now i am usually up at 4:30or 5:00 because of thid dog and the geese. i know i can't do anything about the geese but what can i do about the dog? no nasty answers please! thnaks

Visitors car towed on first occurrence with no pass by HOA. Any room to fight it?

Father in laws car towed from the street. They stayed with us Friday night, woke up Saturday morning and it was gone. Figured it was stolen because we didn't think they would tow it for any reason. Yes, we did not give them the pass, they got in late and it didn't even cross our mind. For sure our fault there but after reading a recent update to the parking rules the board decided to change the rule that any car without a pass will be towed on the first occurrence. This seems pretty ridiculous to all of us. Have to wait tell Tuesday to talk to our HOA guy. Going to try and fight it just wanted to see if anyone had any advice on an angle to take. I also take full blame for not giving them the pass so will understand if most people on here will respond with the obvious to bad, deal with it, but for those of you that have some help I really appreciate it. My HOA recently hired me to take care of the pest problems around the neighborhood. I decided to buy a pellet gun instead of risking it with a .22 long. The pellet gun produces around 6 ft-lbs of energy at the muzzle and I know that this is an effective kill against rats and sparrows if shot in the head. My question is, will this be an effective kill with a heart/lung shot? This will increase the percentage of pests I am able to take.

Im 26 yrs old and i have absolutely no family or friends. My mom remarried wen i was 8 to some asshole who abused me physically n mentally then convinced her to kick me out on my 18 th birhtday.so into the streets i went no education,car,or money. I am completely trapped here with this person we live with her parents and they hate my guts. Even tho i pay them rent, they still treat me like an indentured servant. In 2007 i found my father after twenty or so odd yrs of not seeing him. He lived like 1700 miles away from me but we would talk on the fone all the time. Then 8 months later he had a heart attack and died. My world stood still, the one person on the whole face of this flea infested planet who cared about me was gone. So now i just drift aimlessly thru life with no purpose or direction, cursing my mother for not choosing abortion, smoking pot,getting verbally abused by girl and her parents with absolutely nowhere to go. I cant take it anymore i want to leave this world so bad, but im christian, and im completely terrified of going to hell. So instead i cut myself.incredibly deep. A couple yrs ago i slit my forearm down to my wrist,(the right way!) and ended up bein found by my friend and rushed to the hospital where i got 46 stitches. But i see myself as so pathetic i cant even do that right. Can someone help me. I live on the end row townhouse in a gated community. Almost all the other houses have decks, but mine doesn't. I'm also renting, so I don't want to invest money into my own deck. My wife and I really want to put a patio set out back so we can have BBQ's, etc. The area is very visible from the road. Is there a way to put in a temporary patio that will look good? We have a fairly strict HOA that will have to approve it I'm sure. But I've seen other people with permanent concrete/brick patios - and I'm wondering if there's a product out there I can do quickly that will be low cost.

I asked a question before and mentioned that my boy Ace is all black with some white strand randomly throughout his coat. But when the sun is the brightest and he`s basking in the sun, thats when you see his stripes. But that`s the only time you see his stripes. His son on the other hand i can definatly can say hes a dark brwn tabby and the tabby stripes are very prominent. My question is.....Is there a big possibility i just might have a black tabby. I own an apartment condo in Tampa, FL. I been having a lot of problems with my HOA members. One day(few months ago) my breaker suddenly stopped working. it keeps turning off and has grown weaker. i try to only run one thing at a time now. like AC alone or water heater alone or just washer alone and no dryer.however, one day i had all those off and it turned off and the maintenance person i go to in oder to turn it on is now refusing to do it. saying i must go through the office and ask for a key. (the main breaker is outside is locked) so my access to my breaker is so limited that when it turns off its off for several hours. sometimes almost all day. I goes to the office asking for a key, but i am refused. telling me no i cannot have one because other people breakers are in the box. to have a key all must have the keys and they refuse to do it. at this point i am upset and asked them what am i suppose to do? they gave me an number to call (the maintenance guy #) told me it was free but i shouldn't expect "hotel service". i wait several hrs to come unlock the box and flip the breaker. (like 10-11pm from morning/early afternoon) now i am being charged a fee of $25 just to unlock the box because this is considered "extra service". I am getting abused by my HOA members. They disrespect me and my rights and blame me saying im the one being rude and disrespectful. i never yelled,badmouthed,or been rude. i talked to them in a serious and upset tone after being denied and refused my rights. they argue they are not there to serve us. I pay my HOA fee every month no fail. i been called a lair, disrespected, and abused. I been to the doctor to get stress medication, because all this is having serious affect to my condition. yesterday i felt i was about to have a heart attack, i try so hard not to talk to them not to get worked up but i cannot stand for this when i know i should not have to. i do not want to take pills, i do want these problems but it keeps adding and i feel worse each day. i break down and cry and get angry and get stress and i panic and i feel like i cannot breath from all these stress and abuse. Are they allow to get always with this? Should i be treated in such a way and have no rights? I am trying to contact a lawyer for this as well. but it becoming diffcult to get the copy of papers i need from the HOA, since they say its not their responsiblie and i will charged for copies i never gotten(that i was suppose to be given to me when i bought the apartment).
